The City of Stuart is requesting a Utility Easement for an extension of services on SE Witham Field Drive within the Martin County Airport parcel, to APP Jet Center's Hangar 10.

In compliance with Section 139.50 General Ordinances, Martin County Code, prior to granting this easement, the Board must consider the following:

1. The easement facilitates provisions of the utility's service on the County-owned parcel and provides added value to the site.
2. The service promotes the general welfare by providing the needed service for APP Jet Center.
3. The existence and location of the easement will not interfere with the use by County of the County property.
4. There is no consideration to be paid for the easement as it will provide for utility services needed on County-owned property.
5. The City of Stuart will cooperate in moving the easement if the County should require.

A sketch and legal description for the Utility Easement has been provided to, reviewed, and approved by the County Surveyor.

ISSUES:

The Utility Easement will be brought before the City of Stuart City Commission for approval once granted and executed by the Board of County Commissioners.

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, and staff have identified and addressed legal risks and developed strategies for legal defensibility, as applicable.

RECOMMENDED ACTION:

RECOMMENDATION
Move that the Board (i) grant a Utility Easement to the City of Stuart on County-owned property, in compliance with Section 139.50, General Ordinances, Martin County Code, for utility service for APP Jet Center's Hangar 10 at Martin County Airport, Witham Field, in the City of Stuart and (ii) authorize the Chair to execute all documents necessary to complete this transaction.
