This is a request for the adoption of a Resolution approving and accepting a Quit Claim Deed from the Rogers Revocable Trust for 900+/-square feet along the privately owned and maintained roadway known as SE Cactus Trail.  This property is adjacent to property recently acquired as part of the lands recommended by the Environmental Lands Oversight Committee (ELOC) and approved by the Board of County Commissioners.

Martin County acquired 3.29+/- acres of land from the Rogers Revocable Trust by Warranty Deed dated May 20, 2026 (OR BK 3568, PG 433), which acquisition was accepted and approved by the Board of County Commissioners under Resolution No. 26-4.11 (OR BK 3568, PG 425).  The property was recommended by the ELOC as part of the 2024 ten-year voter-approved tax referendum for environmentally sensitive lands.  A portion of the property acquired in the transaction is located along the privately owned and maintained roadway known as SE Cactus Trail within Chuck Wagon Village in Hobe Sound.

 

Upon review of title work prior to closing, the Survey Division, Real Property and County Attorney’s Office identified an April 24, 1970 Quit Claim Deed from Ellen L. Burrows, the owner at the time of the lots within the unrecorded plat of Chuck Wagon Village, transferring ownership of the private roadways included in the plat with the purpose “to convey one-half of each portion of roadway to the abutting lot owners…” (encompassing Lots 1 through 24).  Based upon the review, it was determined the 900+/- square feet of roadway abutting Lot 18 should also be conveyed to Martin County.

 

Mr. and Mrs. Rogers, as Trustees of the Rogers Revocable Trust, Sellers of Lot 18 under the 3.29+/- acre transaction, agreed to provide a Quit Claim Deed to Martin County for any ownership in that portion of private roadway abutting Lot 18, at no additional cost to the County.

 

Sections 139.31 and 139.32, General Ordinances, Martin County Code, require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by Resolution of the Board of County Commissioners of Martin County.

RECOMMENDATION

Move that the Board:

1)                     adopt a Resolution approving and accepting the Quit Claim Deed from R. Julian Rogers and Estaline A. Rogers, Co-Trustees of the Rogers Revocable Trust, transferring 900+/- square feet of SE Cactus Trail abutting Lot 18; and

2)                     authorize the County Administrator or designee to execute all documents necessary to complete this transaction.
