This is public hearing requested by HJA Design Studio on behalf of Finland Capital, LLC for approval of a rezoning from RM-8, Medium Density Residential District to a Planned Unit Development (PUD) including a PUD zoning agreement and master/final site plan for the construction of 58 fee simple lots and associated infrastructure on an approximately 8.6-acres resulting in a density of 6.7 units per acre. The property is located on the southeast corner of SW Martin Highway and SW 30th Avenue in Palm City. Included in this application is a request for a certificate of Public Facilities Reservation.

BACKGROUND/RELATED STRATEGIC GOAL:

 

On August 16, 2016 the Future Land Use (FLU) on this approximate 8.6-acre undeveloped property was changed from Rural Density to Medium Density by way of the Comprehensive Growth Management Plan Amendment (CPA 16-7, Legg LUA) and adoption of Ordinance 1010. On the same date, Resolution 16-8.12 amended the Martin County zoning district classification on the property from A-1, Small Farms District to RM-8 Medium Density Residential District.

 

This proposal for rezoning to PUD including a master/final site plan is for the purpose of constructing 51 two-story townhome units in eleven buildings, 6 three story duplex units and 1 three story single-family home and the associated infrastructure and amenities on the property. 1.25 acres or 29.5% of the existing native habitat is protected by way of the Preserve Area Management Plan (PAMP) that is part of the PUD Zoning agreement. The applicant has asked for relief on setbacks, minimum lot sizes for the duplex and single-family units as well as relief on standard parking dimensions for some of the units. The applicant has proposed public benefits that include a donation of $50,000 toward the Palm City CRA improvements on Mapp Road and $50,000 for projects and/or improvements at Hidden Oaks Middle School that would be released at the time of the first building permit.

 

A plat application is currently under review for this property.

 

This matter is scheduled to be heard by the Local Planning Agency (LPA) on July 17, 2025, the LPA’s recommendation will be forwarded to the Board.

Because this request involves the application of a policy to a specific application and site, it is a quasi-judicial decision. Quasi-judicial proceedings must be conducted with more formality than a legislative proceeding. In quasi-judicial proceedings, parties are entitled - as a matter of due process - to cross-examine witnesses, present evidence, demand that witnesses testify under oath, and demand a decision based on a correct application of the law and competent substantial evidence in the record.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move that the Board receive and file the agenda item and its attachments including the staff report as Exhibit 1.

2.                     Move that the Board adopt the resolution approving the rezoning from RM-8, Medium Density Residential District to Planned Unit Development and approve the Paddock at Palm City PUD Zoning Agreement including the Master and Final Site Plan.
