On October 25, 2011, an Interlocal Agreement (ILA) was executed between the Martin County Board of County Commissioners (County) and the City of Stuart (City) allowing the County to purchase additional reclaimed water to meet the irrigation capacity needs of its utility service and for the benefit of the region. The County has determined that the original ILA is no longer beneficial and desires to terminate the Agreement.

BACKGROUND/RELATED STRATEGIC GOAL:
The original ILA requires the County to pay for 375,000 gallons per day of reclaimed water to the City, which is currently roughly $6,000 per month, regardless of whether it takes the reclaimed water or not. The last time the County received reclaimed water from the City was December 5, 2022. The original ILA has a termination clause that requires 5-year written notice for termination. The original ILA is attached to this agenda item.
The Amendment changes the termination for convenience provision in the ILA from 5 years to 90 days' notice. If approved, the Amendment will allow the County to terminate the ILA with 90 days' notice to the City of Stuart, saving the County approximately $6,000 per month.
