The Humane Society of the Treasure Coast, Inc. is requesting the release of a Unity of Title for the Humane Society of the Treasure Coast project at 4100 SW Leighton Farm Avenue in Palm City.  The release of the Unity of Title is required to convey a 50 foot wide section of right of way on SW Leighton Farm Ave to Martin County.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The applicant submitted an application for a Revised Minor Final Site Plan for The Humane Society of the Treasure Coast, Inc. located at 4100 SW Leighton Farm Avenue. It was determined that the applicant is required to dedicate a 50-foot-wide section of right of way to Martin County.

In order to convey the property to Martin County it is necessary to release that portion of the property from the existing unity of title, recorded in Official Records Book 1526, at page 0086, in Martin County, Florida Public Records. Staff has prepared a resolution to accept the release of the unity of title.

Section 139.31 and 139.32, General Ordinances, Martin County Code require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by resolution by the Board of County Commissioners of Martin County.  Staff has prepared a resolution accepting the conveyance.

A new Unity of Title will be included with the revised final site plan currently under review.

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board approve the resolution releasing the Unity of Title for The Humane Society of the Treasure Coast, Inc.

Move that the Board approve the resolution accepting a 50 foot wide section of right of way for SW Leighton Farm Avenue from The Humane Society of the Treasure Coast, Inc., a Florida not for profit corporation, F/K/A The Animal Rescue League of Martin County, Inc. to Martin County by Warranty Deed and authorize the Chairman to execute any and all documents necessary to complete the transaction.
