FPL has requested approval of a utility easement from Martin County for service to Lake Point Phase I, LLC. (Lake Point).   The utility easement is adjacent to the Lake Point driveway on the Martin County property along Kanner Highway.

In January 2018, Martin County acquired approximately 416 acres from Lake Point.  As part of the acquisition, Martin County provided Lake Point an Access Easement. The main entrance is an improved driveway off Kanner Highway. Lake Point requires additional electrical service to its property and FPL has provided Martin County, as the property owner, a Utility Easement which will run adjacent to the improved driveway on the County owned property.

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, has identified and addressed legal risks, and has developed strategies for legal defensibility.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

Move that the Board grant Florida Power & Light Company the utility easement and authorize the Chairman to execute any and all documents necessary to complete this transaction.
