Section 102.141 Fla. Stat. establishes the composition and duties of the County Canvassing Board (Canvassing Board). One of the requirements is to have the Chair of the Board of County Commissioners (Board) or a county commissioner on the Canvassing Board who is not an active participant in the campaign or candidacy of any candidate with opposition in the election. Staff is requesting the Board to appoint Commissioner Stacey Hetherington to the Canvassing Board and advising you that in accordance with Section 102.141 (1)(d) an alternate will be assigned by Chief Judge Lawrence M. Mirman.

BACKGROUND/RELATED STRATEGIC GOAL:

Per Section 102.141(1) Fla. Stat.: 'the county canvassing board shall be composed of the supervisor of elections; a county court judge, who shall act as chair; and the chair of the board of county commissioners.' The Chair of the Board is in an active campaign and therefore is not eligible to serve on the canvassing board. The Commissioner to be assigned cannot be active in their campaign or the campaign of others.

Staff is requesting Commissioner Hetherington be assigned to the canvassing board. Commissioner Hetherington is currently Martin County's Republican State Committeewoman and is eligible to be on the canvassing board as long as she does not have an opponent in the general election. Should that occur, the alternate assigned by Chief Judge Mirman in accordance with Section 102.141(1)(d) would then be placed on the canvassing board and another alternate assigned by the Chief Judge.
