The Treasure Coast Wildlife Hospital (“TCWH”) was awarded a Tourism Capital Improvement Grant. A grant agreement between the TCWH and the Board of County Commissioners (“BOCC”) was signed May 1, 2018 (“Agreement”). Terms included funding be used within 26 months. Due to unforeseen circumstances, the project was unable to start. At its February 5, 2020 meeting, the Tourist Development Council (TDC) approved recommending a two-year extension of the Agreement until July 2022 or until maximum of $241,624.20 is met, whichever occurs first. The TDC requests the BOCC approve the proposed First Amendment to the Agreement to extend the Agreement.

BACKGROUND/RELATED STRATEGIC GOAL:
TCWH was awarded funding as part of Martin County’s Tourism Capital Improvement Grant by the Board of County Commissioners in the amount of $241,624.20 in May of 2018. The funds awarded must be used to build a new 5000 square foot multipurpose wildlife center. Tourist Development Capital Project Grant Program was intended, by ordinance, to provide grants to tourism related organizations in order to provide for the acquisition, construction, extension, enlargement, remodeling, repair and/or improvement of a museum, exposition center, nature center and other tourist-related attractions. The Agreement between the Treasure Coast Wildlife Hospital and the Board of County Commissioners was signed on May 1, 2018. Under the terms of the Agreement, the funds had to be used within 26 months. After signing the Agreement, due to unforeseen circumstances, TCWH was unable to begin construction of the project until this year. The project will not be completed by the July 31, 2020 deadline. TCWH requested an extension of the Agreement so it can complete the project using the funds awarded in the grant. At its February 5, 2020 meeting, the Tourist Development Council evaluated and approved recommending a two-year extension of the Agreement until July 31, 2022 or until the Agreement maximum of $241,624.20 is met, whichever occurs first. The First Amendment to the Agreement only extends the term of the Agreement for 2 years. All other provisions of the May 1, 2018 Agreement will remain the same. The Tourist Development Council requests that the BOCC approve the proposed First Amendment to the Agreement to extend the term of the Agreement until July 31, 2022.
