For over 27 years the Martin County Board of County Commissioners (Board) and the School Board of Martin County (School Board) have had agreements for mutual use of amenities at Hidden Oaks Middle School and Hobe Sound Elementary School.  During the course of these agreements physical changes and use of facilities have eliminated public programming at these sites.

BACKGROUND/RELATED STRATEGIC GOAL:

 

The Board, the School Board and the Hobe Sound Elementary PTA entered into an agreement related to the “Kids Kingdom” playground at Hobe Sound Elementary in 1992. Since that time this playground has been removed and there is no longer public access to a playground at this school. The Board and the School Board also entered into an agreement for the track, baseball/softball fields and basketball courts at Hidden Oaks Middle School in 1992. Over time, fencing has been added by the School Board that limits access to these facilities and reservations for use of these facilities have declined to zero. Martin County continues to maintain these facilities at an average annually cost of $26,333.

 

Staff recommends terminating these two interlocal agreements as there is no longer mutual use of the facilities for school purposes and by the public. These interlocal agreements require termination be agreed upon by written agreement of both parties. In meetings with School Board staff, Martin County staff has informed the School Board that we intend to terminate these two agreements.

This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law.

 

RECOMMENDED ACTION:

 

RECOMMENDATION

1.                     Move that the Board approve the mutual termination of the June 16, 1992 Interlocal Agreement for Hidden Oaks Middle School, as amended on June 18, 2008 and the July 23, 1992 Interlocal Agreement for Hobe Sound Elementary School.

2.                     Move that the Board approve ceasing all County operations and funding provided under these agreements on September 30, 2020.
