BACKGROUND/RELATED STRATEGIC GOAL:
The Treasure Coast Community Action Agency Advisory Board is composed of nine members - three each from Martin, Okeechobee, and St. Lucie Counties. The Advisory Board is charged with the development and oversight of the Community Services Block Grant services which are provided through the Treasure Coast Community Action Agency. The State of Florida, Department of Economic Opportunity, receives funds from the federal government and distributes them to Community Action Agencies throughout the state. Three counties (Martin, St. Lucie, and Okeechobee) comprise the Treasure Coast Community Action Agency. The St. Lucie County Board of County Commissioners is designated as the eligible entity to receive Community Services Block Grant funds for this three-county agency. Community Services Block Grant program funds are designed to provide a range of services to assist low income people in attaining the skills, knowledge, and motivation necessary to achieve self-sufficiency. Types of assistance include but not limited to: transportation assistance, nutrition programs, emergency food and housing, and homeless prevention programs.
The three members that Martin County appoints are:
• one elected official currently holding office or designated representative (Jennifer Salas represents the Commission);
• one representative of business, industry, labor, religious, welfare, or education interests in the county so specified (Jerry Gore, Sr.); and
• one representative of low-income population chosen by a democratic selection procedure adequate to assure that there are representatives of the poor in the area served (Yvette R. Gregory).
On November 2, 2020, the Administration Staff advised Mr. Gore that his term will expire on January 8, 2021 and he was provided an Application for Appointment to complete and return if so desired.
An Information Release soliciting applicants was emailed to the Outreach Martin email list which includes local Chambers of Commerce and local media. The Information Release was also posted to the County’s web page under News.
The Administration staff will advise the applicants of the Commission’s decision which will include Sunshine Law information. The Administration Staff will mail a letter and certificate of appreciation to Mr. Gore if he is not re-appointed which will be signed by the Chair.
ISSUES:
The Board is asked to appoint one individual to the Treasure Coast Community Action Agency Advisory Board for a three-year term to begin January 9, 2021 and expire January 8, 2024. A voting sheet is attached.

LEGAL SUFFICIENCY REVIEW:
This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law.
Section 112.313(7), Fla. Stat. prohibits a public officer, including an advisory board member, from holding employment or a contractual relationship with a business entity or agency which is doing business with an agency of which he or she is an officer. Section 112.313(12), Fla. Stat. provides a waiver of this prohibition for persons serving on advisory boards. There must be a full disclosure of the relationship to the Board prior to the appointment and the Board, by a 2/3 vote, must vote in favor of waiving the prohibition.
Applicant Christine Georges works for the Children’s Services Council. The Children’s Services Council is doing business with the County. If the Board desires to appoint Christine Georges, it must first vote to waive the prohibition of Section 112.313(7), in accordance with Section 112.313(12).
RECOMMENDED ACTION:
RECOMMENDATION
Move that the Board appoint one individual to the Treasure Coast Community Action Agency Advisory Board for a three-year term to begin January 9, 2021 and expire January 8, 2024 and authorize the Chair to sign the letter and certificate as described under Background if needed.
If the Board desires to appoint Christine Georges, it must first vote to waive the prohibition of Section 112.313(7), in accordance with Section 112.313(12).
