BACKGROUND/RELATED STRATEGIC GOAL:
In 2006, the legislature created Section 125.379, Florida Statutes, relating to the disposition of county property for affordable housing. The statute requires:
a) The County provide an inventory list of County fee simple title property that is appropriate for affordable housing by July 1, 2007 and every three years thereafter;
b) The list be reviewed and possibly revised by the governing body of the County at a public hearing; and
c) The governing body of the County adopt a resolution that includes an inventory list of such property following the public hearing.
The current affordable housing list was approved by the Board of County Commissioners on March 13, 2018, by Resolution No. 18-3.7, to include four County owned parcels identified as appropriate for affordable housing.
In preparation for this Item, staff obtained a list of county owned property within the Urban Services District from the Property Appraisers’ office. Real Property worked in conjunction with other departments to identify the designated/proposed use of the parcels and whether or not they were appropriate for affordable housing.
Based upon the research, staff found there are no additional properties identified as appropriate for the affordable housing list and that the properties currently on the list are no longer appropriate and should be returned to the County’s surplus property list for sale.
ISSUES:
Martin County may make any of its property available for affordable housing at any time pursuant to Section 125.38, Florida Statutes.

This item has been reviewed for legal sufficiency to determine if it is consistent with applicable law, has identified and addressed legal risks, and has developed strategies for legal defensibility.
RECOMMENDED ACTION:
RECOMMENDATION
• Move that the Board adopt a Resolution which identifies there are no current county owned properties identified for affordable housing in accordance with Section 125.379, Florida Statutes; and
• Authorize the Chair to execute any and all documents necessary to complete this transaction.
