BACKGROUND/RELATED STRATEGIC GOAL:

 

1. Agreement prepared by:                                                               Martin County (Legal & Utilities Departments)

3. Purpose of the Agreement:                     To provide a mechanism to modify the original Reclaimed Water Agreements for various reasons including changes of ownership and reclaimed water allocation.

5. Duration:                     No expiration date is being established

 

6. Benefits to Martin County:                     The proposed template will allow for changes to existing Reclaimed Water Agreements to be executed by the Director of the Utilities & Solid Waste Department, or designee, without having to obtain Board of County Commissioners approval. As most of these Amendments involve either changes of ownership or allocation, the changes are usually minor and do not substantially change the Agreement.

 

7. Costs to Martin County:                                                               N/A

 

The Board has previously authorized the Utilities & Solid Waste Department Director to execute standard Agreements that have been approved by the Board of County Commissioners. These Agreements include Developer Agreements, Non-Exclusive Roll-Off Franchise Agreements, and Grinder Installation and Maintenance Agreements.

 

The proposed Reclaimed Water Agreement Amendment is requested to be added to the above list of Agreements that will be executed by the Department Director.

RECOMMENDATION

Move that the Board approve the Reclaimed Water Agreement Amendment Template and authorize the Director of the Utilities & Solid Waste Department, or his/her designee, to execute Reclaimed Water Agreement Amendments.
