BACKGROUND/RELATED STRATEGIC GOAL:
Section 43, Article 1 “Construction Industry Licensing Board” General Ordinances, Martin County Code, provides, “There shall be a County board known as the Construction Industry Licensing Board of Martin County, Florida, hereinafter referred to as the “CILB”, which shall consist of nine members appointed by the Board of County Commissioners.
Prior to appointment, each member of the CILB shall be a registered voter in Martin County and all contractor members shall have been actively operating in the construction industry in Martin County for at least three consecutive years as a County-licensed or State-certified contractor. No member shall hold another elective public office or be an employee of Martin County or any municipality within Martin County. The CILB shall have nine members and be composed of the following:
2, each of whom shall be either a general, building or residential contractor;
1 electrical contractor;
1 plumbing contractor;
1 heating, air conditioning, refrigeration, ventilation contractor, hereinafter HARV;
1 registered architect or registered engineer; and
3 consumer representatives who are not and have never been members or practitioners of any profession regulated by the Martin County Construction Industry Licensing Board or a member of any closely related profession.
After the initial appointment, all appointments shall be for a three-year term beginning on November 30. The member’s term of office shall terminate earlier at the pleasure of the Board of County Commissioners, or automatically if the member: ceases to be a registered voter in Martin County, ceases to be qualified pursuant to Section 43.2 (Qualifications of Members), or fails to attend three successive, regularly scheduled, monthly meetings.
The Construction Industry Licensing Board meets in the Commission Chambers at 4:00 PM usually on the fourth Wednesday of each month. Their agendas are published to the County’s web site in a timely manner.
On January 25, 2021, Administration staff advised Charlene Oakowsky that her term will expire on March 23, 2021. Ms. Oakowsky was sent an application to complete and return if so desired.
An Information Release soliciting applicants was emailed via Constant Contact to the Outreach Martin email lists which includes local Chambers of Commerce, local businesses, local media, and citizens (well over 2,600 recipients). The Information Release was also posted to the County’s web page under News.
During the January 27, 2021 Construction Industry Licensing Board meeting, Douglas Baumgarten announced his retirement from the Board effective immediately. Per previous Board direction, Administration Staff sent Mr. Baumgarten a framed Certificate of appreciation and a letter thanking him for his serving (since 2012) which were signed by the Chair.
Administration Staff confirmed through the Supervisor of Elections Office that the applicants listed below are Martin County registered voters as required.
The Administration Staff will advise all the applicants of the Commission’s decision which will include Sunshine Law information to the appointed individuals. A Chair letter and framed Certificate of Appreciation will be mailed to Ms. Oakowsky if she is not reappointed. The Chair will sign the letter/certificate.
ISSUES:
The Board is asked to appoint two individuals to the Construction Industry Licensing Board. One appointment should be to complete the term of Mr. Baumgarten and end November 29, 2021. The second appointment should be for a term ending November 29, 2022.
During the course of the review of this agenda item, it was discovered that due to numerous changes in the consumer representative positions over the years, the terms currently held by Ms. Oakowsky and the third consumer representative, Corey Weiner, are not consistent with the requirement of Section 43.2 to have staggered three-year terms for the consumer representatives beginning on November 30th. This issue can be rectified within the attached draft resolution appointing one consumer representative to a term beginning immediately and ending November 29, 2021; appoint one individual for a term to begin March 24, 2021 and ending November 29, 2022; and extending the term of Corey Weiner to November 29, 2023. RECOMMENDED ACTION:
RECOMMENDATION
Move that the Board appoint one individual to the Construction Industry Licensing Board for a term to begin immediately and end November 29, 2021; appoint one individual for a term to begin March 24, 2021, and end November 29, 2022; and extend the term of Corey Weiner to November 29, 2023. In addition, the Board is asked to authorize the Chair to sign the Resolution of Appointment and any letters/certificates.
